Here is an example of a greenfield subdivision we did:
- The beneficiaries of an estate saw an opportunity with zoning laws changing to do a greenfields subdivision of a previously farm area in Whitford.
- We came on board after the subdivision consent had been obtained. By this stage, a few sections in the subdivision had been sold. We initially assigned these pre-sales over to our client’s development company.
- We advised on obtaining developer finance including various securities required by the bank.
- We advised around bonds: bond for head contractor (and assigning interest to mortgagee); bond for completion of planting & maintenance in ecological areas
- We drafted:
- Maintenance covenants (internal roads and systems) with criteria for how owners of the subdivided lots make decisions (unincorporated society),
- Restrictive covenants re building & using the lots
- Various easements
- Liaised with surveyor about survey plan
- Applied for legal titles with LINZ
- Completed conveyancing and settlements of all subdivision sections
