Here is an example of a greenfield subdivision we did:
 
  • The beneficiaries of an estate saw an opportunity with zoning laws changing to do a greenfields subdivision of a previously farm area in Whitford.
  • We came on board after the subdivision consent had been obtained. By this stage, a few sections in the subdivision had been sold. We initially assigned these pre-sales over to our client’s development company.
  • We advised on obtaining developer finance, including various securities required by the bank.
  • We advised around bonds: bond for head contractor (and assigning interest to mortgagee); bond for completion of planting & maintenance in ecological areas
  • We drafted:
    • Maintenance covenants (internal roads and systems) with criteria for how owners of the subdivided lots make decisions (unincorporated society),
    • Restrictive covenants re building & using the lots
    • Various easements
    • Liaised with surveyor about survey plan
  •  Applied for legal titles with LINZ
  • Completed conveyancing and settlements of all subdivision sections
