  1. Sale and Purchase of Commercial Properties (retail, industrial and commercial)
  2. Commercial leases (Agreements to lease, Deeds of Lease, Assignments/Sub-leases, Renewals & Variations)
  3. Subdivisions – Greenfield (all aspects including: vendor finance, bonds, restrictive covenants, maintenance covenants, prepare other interests on the title, review survey plans & resource consents for 223/224c, registration of titles)
  4. Residential and Commercial Unit title developements

Here is an example of a greenfield subdivision we did:
 
1. The beneficiaries of an estate saw an opportunity with zoning laws changing to do a greenfields subdivision of a previously farm area in Whitford.
2. We came on board after the subdivision consent had been obtained. By this stage, a few sections in the subdivision had been sold. We initially assigned these pre-sales over to our client’s development company.
3. We advised on obtaining developer finance, including various securities required by the bank.
4. We advised around bonds: bond for head contractor (and assigning interest to mortgagee); bond for completion of planting & maintenance in ecological areas
5. We drafted:
  • Maintenance covenants (internal roads and systems) with criteria for how owners of the subdivided lots make decisions (unincorporated society),
  • Restrictive covenants re building & using the lots
  • Various easements
  • Liaised with surveyor about survey plan
6. Applied for legal titles with LINZ
7. Completed conveyancing and settlements of all subdivision sections
